Terms and Conditions of Sale
FridaHats Online OÜ, registry code 16092783, legal address Võpsiku, Odulemma, Saue parish, 76210 Harjumaa (hereinafter E-shop), and the Customer who places an order in the e-shop https://fridahats.com managed by FridaHats Online OÜ and identifies him- or herself by entering his or her personal data (hereinafter the Customer) in the order, has agreed to these terms and conditions (hereinafter the Terms and Conditions of Sale).
1. General Terms and Conditions
1.1. The parties shall be guided by the laws and other legal acts of the Republic of Estonia and the agreement in the Terms and Conditions of Sale when regulating their mutual relations.
1.2. The E-shop has the right to make changes to their offered E-shop services at any time.
1.3. The E-shop may change and update these Terms and Conditions due to the development of the e-shop and in the interests of better and safer use of the E-shop. Changes and additions to the Terms and Conditions will be notified via the website https://fridahats.com. Amendments and updates to the Terms and Conditions shall enter into force upon publication of the respective amendment or update on the website https://fridahats.com. If you have submitted your order before the changes to the terms came into force, the Terms and Conditions in force at the time of submitting the order shall apply in accordance with the legal relationship between you and the E-shop, unless otherwise provided by law or these terms.
1.4. Before making a purchase, the customer can save, print and, if necessary, reproduce the Terms and Conditions, and the customer agrees with the provisions of the conditions when making a purchase from the e-store.
1.5. The user of the service confirms that he or she is a resident of Estonia at least 18 years of age and that he or she has active legal capacity and his or her active legal capacity is not restricted.
2. Products and Purchasing
2.1. The products displayed in the E-shop may not always be in stock.
2.2. If the product is not in stock and the order cannot be fulfilled, the employee of the E-store will contact the Customer, offer a possible new delivery time or replace the product with another product of equivalent price and quality. In this case, the Customer has the right to refuse the new conditions and the money paid for the order will be refunded.
2.3. The product images shown are for illustrative purposes only and may differ from the actual product.
2.4. The product descriptions in the online store may not be exhaustive and may contain unintentional errors.
2.5. The customer who wishes to purchase the selected products from the E-store undertakes to enter the information required to complete the order (first name, surname, contact telephone number, e-mail address, delivery address, postal code, method of payment) and pay for the product in the chosen way.
2.6. The customer undertakes to provide true data when completing the order. The E-shop is not responsible for non-fulfillment of the order due to incorrect data provided by the Customer or any consequences thereof.
2.7. The order will be processed in the E-shop only after the payment has been received. The order is not prepared (stock check) before the payment is received.
2.8. The term for payment for orders is three (3) working days. The service provider has the right to cancel orders not paid on time.
3.1. All prices in the E-shop are in euros and include current VAT in the Republic of Estonia.
3.2. The various possible shipping costs for the selected items are fully calculated in the shopping cart. The Customer can see the cost of different shipping methods in the Shopping Cart at the Payment step without placing an order.
3.3. The E-shop has the right to change the prices of products at any time.
3.3. The E-shop has the right to change the prices displayed in the E-shop at any time. If the prices in the E-shop have changed after the Customer has submitted the order and paid for it, the corresponding products will be delivered to the Customer at the prices valid at the time of the order. The customer has no right to demand compensation for the price difference.
4. Delivery time and delivery conditions
4.1. The delivery time of the products is usually up to five (5) working days, unless otherwise stated for the product. If the delivery time of the ordered products exceeds five working days, the employee of the E-shop will immediately inform the Customer. If necessary, the Customer has the opportunity to cancel the order and the money already paid will be returned to the Customer.
4.2. The E-shop has set different free transport rates according to the agreements concluded with postal service companies. More detailed information can be found in the Shopping Cart or on the Terms of Delivery page.
4.3. The customer has the opportunity to choose between the following methods of receiving the goods: receipt from the FridaHats Online OÜ office (Roosikrantsi 11, Tallinn, prior agreement required) or choose Omniva standard package, Omniva courier service, DPD courier service or Itella SmartPOST as the method of sending the package.
4.4. Delivery of orders usually takes place only in the territory of the Republic of Estonia.
5. Withdrawal from the agreement before the E-shop performs the agreement
5.1. If the Customer wishes to withdraw from the order after submitting the order and before the performance of the contract by the E-shop, the Customer undertakes to notify the E-shop immediately in writing. Written notice must be sent to the e-mail address: firstname.lastname@example.org. The e-mail must state the date of submitting the order and the order number from which you wish to withdraw, and include the Customer’s contact information (first name, surname, contact telephone number).
5.2. If the withdrawal application reaches the E-shop after the performance of the contract, the withdrawal from the contract will take place in accordance with clause 6 of the Terms and Conditions of Sale (Right of Return).
5.3. The E-shop will refund the amount paid to the Customer as soon as possible, but not later than within fourteen (14) calendar days from the receipt of the request to withdraw from the contract.
5.4. The money is transferred to the same account from which it was received in the E-shop.
6. Right of return
6.1. After receiving the order, the Customer has the right to withdraw from the contract entered into in the E-shop without giving a reason within 14 days.
6.2. The returned product must be free of defects, complete, in the original packaging and unused.
6.3. To return the product, a corresponding request must be submitted to the e-mail email@example.com.
6.4. The transportation costs associated with the return are covered by the Customer.
6.5. The E-shop will refund the amount paid for the order to the Customer as soon as possible, but not later than within fourteen (14) calendar days from the receipt of the return request from the contract. The money is transferred to the same account from which it was received by the Service Provider.
6.6. If the goods are damaged, which could not be identified by external inspection and which did not occur when the package was opened, or if the goods are not what the Customer ordered, the return cost will be borne by the E-shop. When returning the goods, the customer must add a receipt for the postage to the package.
6.7. If, after returning the product, it turns out that the product does not meet the requirements set out in the Sales Conditions of the E-store, the E-store has the right to refuse to send the customer an exchange product or return the money.
6.8. Products purchased at a discounted price are not refundable. The product can be exchanged for an equivalent suitable product. The transport costs associated with the exchange are covered by the customer.
6.9. If the customer wishes to exchange the purchased product for another product of the same or different size, the customer will cover all transport costs associated with the exchange.
7. Procedure for handling claims
7.1 The e-shop is responsible for non-compliance of the goods sold to the Customer with the terms of the contract or for defects that appear within two (2) years from the delivery of the goods to the Customer.
7.2. The E-shop is not responsible for the occurrence of defects in the product due to the fault of the Customer, defects that have arisen as a result of irregular storage or use of the product. Deficiencies include defects in the product, but not defects in the product packaging.
7.3. In case of non-compliance or defects of the product, the Customer has the right to demand the replacement of the product with a compliant or non-defective product or withdrawal from the sales contract and return of the goods at the expense of the E-store. In case of withdrawal from the sales contract, the E-shop will reimburse the Customer for the amount paid for the goods together with the postage to the Customer’s bank account as soon as possible, but not later than within 14 days after returning the goods and checking and identifying defects.
7.4. In case of non-compliance or defects of the product, please send a complaint to the e-mail address firstname.lastname@example.org, stating the name of the orderer, contact telephone number, order number and a precise description of the non-compliance or defect of the product.
7.5. A claim in case of non-conformity or defect of the product must be submitted within two months from the discovery of the non-conformity or defect of the product.
7.6. All claims will be reviewed and the Client will be contacted as soon as possible, but not later than within 14 days from the receipt of the claim.
8. Processing of personal data
8.1. The Customer gives clear and informed consent to the E-shop to process his or her personal data.
8.2. The personal data entered by the Customer upon submitting the order is entered in the customer register of the E-shop and used to provide sales services and goods to the Customer.
8.3. The source of personal data is the formation of a customer relationship when registering an order in the E-shop.
8.4. The personal data to be registered includes data on the Customer and the order (surname, first name, street, house, apartment number, settlement or city, postal code, telephone number, year of birth, sex, delivery method, payment method used, E-shop Accepting sales conditions, sending sales offers comments entered).
8.5. Personal data is processed by FridaHats Online OÜ, registry code 16092783, legal address Võpsiku, Odulemma, Saue parish, 76210 Harjumaa.
8.6. Personal data necessary for the brokerage of goods to the Customer shall be forwarded to the companies providing brokerage services.
8.7. The protection of personal data is guaranteed by all security measures required by law.
8.8 The E-shop undertakes not to transfer registered personal data to unauthorized persons.
8.9. The E-shop reserves the right to transfer personal data concerning the Customer to persons who have a legal right to do so and who process the data to fulfil an obligation prescribed by law and to persons who have a legal right to do so to protect the life, health or freedom of the Customer or another person.
8.10. The customer has the right to check the personal data concerning him or her, as well as to change them or remove the data from the register.
8.11. The Customer consents to the E-shop sending an order confirmation to the e-mail address entered when submitting the order.
8.12. The Customer consents to the E-shop sending sales offers to the e-mail address entered when submitting the order, if he or she has marked the respective consent with a tick in the corresponding window on the order submission page.
9. Liability and force majeure
9.1. The E-shop is liable to the Customer and the Customer is liable to the E-shop for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
9.2. The E-shop is not responsible for any damages caused to the Customer or for the delay in the delivery of the goods if the damage or the delay in the delivery of the goods is due to circumstances that the E-shop could not influence or foresee.
10.1. It is obligatory for the Customer to get acquainted with the terms and conditions provided in the Terms and Conditions of Sales.
10.2. By submitting the order, the Customer agrees to the conditions set out in the User Agreement.
